Terms & Conditions
1. Introduction
These Terms and Conditions apply to the hire of jumping castles and soft play equipment from Lux Play Parties. By booking and using our services, you agree to be bound by these terms. Please read them carefully.
2. Definitions

"Client" refers to the individual or organization hiring the equipment.

"Company" refers to Lux Play Parties, the business providing the jumping castle and soft play hire services.

"Equipment" refers to all inflatable and soft play equipment hired by the Client.

"Event" refers to the event or party for which the equipment is hired.
-
"Bond/Deposit" refers to the refundable security amount paid by the Client to cover potential damage or loss of equipment.
3. Booking and Payment

Booking Process: To confirm a booking, the Client must submit a booking request via our website, email, or phone. Bookings are subject to availability, and the Client will receive a booking confirmation after payment of the deposit.

Deposit/ Bond: A deposit/ bond of $150-$500 depending on value of hire will also be charged at the time of booking. This bond acts as a security against any damage or loss of the equipment during the hire period.

Full Payment: Full payment must be received 3 business days prior to the event. Failure to make full payment will result in the cancellation of the booking, and the deposit will be forfeited.

Accepted Payment Methods: We accept payments via bank transfer.
4. Delivery, Setup, and Collection

Delivery and Setup: The Company will deliver and set up the equipment at the location specified by the Client at the agreed time. The Client is responsible for ensuring the location is suitable for the equipment. Setup will be done by our trained staff.

Space Requirements: The Client must ensure there is sufficient space for the equipment to be set up safely. For jumping castles, a flat, clear and dry area is required. For soft play equipment, a flat area free of debris, water, dirt and hazards is necessary.

Collection: After the event, the Company will return to dismantle and collect the equipment. The Client must ensure the equipment is accessible for collection at the agreed-upon time, standard hire durations are 4-5 hours unless discussed and noted on invoice.
5. Client Responsibilities

Safety: The Client is responsible for ensuring that all users of the equipment (particularly children) use it safely and in accordance with the safety guidelines provided by the Company.

Supervision: The Client must ensure that there is adequate supervision of children using the equipment at all times. The Company does not provide supervision, and the Client is solely responsible for ensuring safety.

Damage or Loss: The Client is responsible for any damage to the equipment during the hire period. If the equipment is damaged or lost due to misuse or negligence, the Client may be charged for repair or replacement costs.

Prohibited Use: The Client agrees not to allow the equipment to be used in any manner other than as intended, including but not limited to:

Jumping castles must not be used during high winds or rain.

The equipment must not be overloaded beyond the safe usage limits as specified.
-
No face paint or glitter should be allowed near the equipment.
-
Food, drink, or chewing gum should not be consumed on or around the equipment.

6. Weather Conditions
-
Jumping Castles & Wind Safety:
-
High Winds: Jumping castles are strictly prohibited from being used in high winds. If wind speeds exceed, 25 km/h, the Client must immediately cease the use of the jumping castle.

Company Responsibility: The Company will monitor weather conditions before and during the event. If wind conditions reach unsafe levels, the Company will contact the Client and instruct them to deflate the jumping castle until wind conditions improve. In some cases, the Company may cancel or delay the setup if conditions are deemed too risky.

Client's Responsibility: It is the Client’s responsibility to ensure that no children or guests use the jumping castle when the wind conditions are unsafe, even if the Company is not present. If winds are forecasted to be strong during the event, the Client agrees to work with the Company to reschedule or make alternate arrangements.

Weather-Related Cancellations: The Company reserves the right to cancel or reschedule the booking in the event of extreme weather, including but not limited to heavy rain, storms, or high winds. For outdoor events, the Client must monitor weather forecasts and work with the Company to make alternative arrangements if needed.

Weather Restrictions: Jumping castles should not be used in wet conditions, and must be fully deflated if the wind exceeds 25 km/h. If these conditions are not met, the Client must ensure the equipment is shut down for safety reasons.
7. Cancellations and Rescheduling

Cancellation by Client:
-
Cancellations made more than 7 days before the event will result in the loss of the deposit only.

Cancellations made less than 7 days before the event will incur a cancellation fee of 50% of the total booking cost.

Rescheduling: If the Client wishes to reschedule, they must inform the Company at least 10 days in advance. Rescheduling is subject to equipment availability and may incur additional charges.

Cancellation by Company: The Company reserves the right to cancel the booking due to severe weather conditions or other unforeseen circumstances that would make it unsafe to set up or operate the equipment. In such cases, the Client will have the option to reschedule or receive a full refund.
8. Bond Refund

Bond Return: Provided there is no damage to the equipment, the bond will be refunded within 3-5 business days after the event.

Damage or Loss: If the equipment is damaged or lost during the hire period, the Company will use the bond to cover repair or replacement costs. If the damage or loss exceeds the bond amount, the Client will be responsible for the remaining costs. Strictly no heels or shoes to be worn on mats, equipment.

Conditions for Bond Return: The bond will only be refunded if the equipment is returned in the same condition as when it was delivered. The Client must ensure that no damage occurs during use and that the equipment is appropriately maintained throughout the hire period.

Cleaning fees: We also charge a cleaning fee if equipment has been left dirty.
9. Liability and Insurance

Public Liability Insurance: The Company holds appropriate public liability insurance for the equipment hired. However, the Client agrees to indemnify and hold the Company harmless from any claims or losses resulting from the use of the equipment.

Client’s Liability: The Client is responsible for any injury, loss, or damage caused by improper use of the equipment, and agrees to cover any repair or replacement costs incurred due to damage caused by misuse or negligence.
10. Equipment Maintenance

The Client agrees to treat the equipment with care and respect. The Company will ensure that all equipment is in safe working order before delivery. The Client must notify the Company immediately if the equipment becomes damaged or unsafe during use.
11. Privacy Policy
The Company will collect personal data, such as names, addresses, and payment details, as part of the booking process. This data will be used solely to process bookings and provide services. We do not share personal information with third parties, except as required by law. Please refer to our Privacy Policy page for further details.
12. Force Majeure
The Company will not be held responsible for any failure or delay in performance under these Terms and Conditions due to causes beyond its control, including but not limited to weather events, traffic, natural disasters, or government restrictions.
13. Changes to Terms and Conditions
The Company reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client before the event date. The updated Terms and Conditions will be available on our website.
14. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising under these Terms and Conditions will be subject to the exclusive jurisdiction of the courts in Melbourne, Victoria.
